SECÇÃO 4 – LOCALIZAÇÃO E PERÍODO DE ARMAZENAMENTO DE DADOS PESSOAIS

Assim, e sempre que não exista uma exigência legal específica, os dados serão armazenados e conservados pelo período necessário às finalidades para as quais foram recolhidos ou fornecidos ou pelo período autorizado pela Comissão Nacional de Proteção de Dados.

SECÇÃO 5 – DIREITOS DO TITULAR DOS DADOS PESSOAIS

QUAIS SÃO OS DIREITOS DO TITULAR?

A qualquer momento, o titular poderá solicitar-nos:

-O acesso à informação que temos sobre si;

– A retificação da informação, caso esteja incorreta ou incompleta;

– A eliminação ou limitação do tratamento dos seus dados pessoais;

– Se o tratamento depender do seu consentimento ou acordo e esse for efetuado por meios automatizados, tem direito ao envio dos dados pessoais anteriormente fornecidos, de forma estruturada, comummente utilizada e num formato informaticamente legível;

– O titular dos dados pessoais tem o direito de apresentar uma reclamação à Comissão Nacional de Proteção de Dados

SECÇÃO 6 – PORTABILIDADE DOS DADOS

O artigo 20.º do RGPD estabelece ainda um novo direito à portabilidade dos dados, o qual está intimamente ligado ao direito de acesso. O objetivo deste novo direito é dar poderes ao titular dos dados, conferindo-lhe um maior controlo sobre os dados pessoais que lhe dizem respeito.

O titular dos dados tem o direito de receber os dados pessoais que lhe digam respeito e que tenha fornecido a um responsável pelo tratamento, num formato estruturado, de uso corrente e de leitura automática, e o direito de transmitir esses dados a outro responsável pelo tratamento sem que o responsável a quem os dados pessoais foram fornecidos o possa impedir.

QUAL O PRAZO IMPOSTO PARA RESPONDER A UM PEDIDO DE PORTABILIDADE?

O artigo 12.º, n.º 3, exige que o responsável pelo tratamento forneça «ao titular as informações sobre as medidas tomadas […], sem demora injustificada e no prazo de um mês a contar da data de receção do pedido». Este prazo de um mês pode ser alargado até três meses no máximo para os casos complexos, desde que o titular dos dados tenha sido informado dos motivos da prorrogação no prazo de um mês a contar da data do pedido inicial.

COMO DEVEM SER FORNECIDOS OS DADOS PORTÁVEIS?

Nos termos do artigo 20.º, n.º 1, do RGPD, os titulares dos dados têm o direito de transmitir os dados a outro responsável pelo tratamento sem que o responsável a quem os dados pessoais foram fornecidos o possa impedir. O artigo 20.º, n.º 2, impõe aos responsáveis pelo tratamento a obrigação de transmitir os dados portáveis diretamente para outros responsáveis pelo tratamento «sempre que tal seja tecnicamente possível».

SECÇÃO 7 – CONSIDERAÇÕES FINAIS
